By purchasing and using this cat flap with prey-detection technology, the customer acknowledges and agrees to the following terms and conditions:

1. Assumption of Risk: The customer assumes all risks associated with the installation and use of the cat flap with prey-detection technology.

2. Compliance with Local Laws: It is the customer’s responsibility to ensure that the device is compliant with all applicable laws and regulations.

3. Limitation of Liability: The manufacturer and seller are not liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the cat flap.

4. Warranty and Replacement Policy: The cat flap is designed to prevent entry with prey, but is provided “as is” without warranties or guarantees. If a specific fault due to a manufacturing defect is identified, a replacement may be offered on a return-to-factory basis.

5. Indemnification: The customer agrees to indemnify the manufacturer and seller from any claims arising out of the customer’s use of the cat flap.

6. Use of Event Data: The customer authorises the use of event data for optimisations and improvements. To opt out, email admin@onlycat.com. Opting out may limit system effectiveness.

7. Data Collection and App Usage: The app collects data concerning your pet to provide the service. This includes pet proximity detection, microchip or collar tag identification, and detected movements of the door. Data interpretation may sometimes be inaccurate due to various factors.

8. Intellectual Property: VirtualV Trading Ltd t/a OnlyCat retains all intellectual property rights related to the cat flap and associated technology.

9. Disclosure of Information: Certain information may be disclosed by law, including in cases of suspected animal abuse or illegal activity.

10. Rights to Pet Data: By accepting these Terms, you assign all rights to the Pet Data to us. If the assignment is not effective, you grant us a perpetual, irrevocable, non-exclusive right to use the Pet Data.

11. Service Availability: We aim to make the Service available 24/7 but do not guarantee uninterrupted or error-free use. Service access may be suspended without notice for system failure, maintenance, or reasons beyond our control.

12. Data Transfer: We are not responsible for delays, delivery failures, or any other loss resulting from data transfer over communications networks.

13. Termination of Service: We may cancel, terminate, or suspend the Service or your Account at any time. We reserve the right to keep all Pet Data following cancellation, termination, or suspension.

14. User Obligations:

    • Do not disassemble, decompile, reverse-engineer, or create derivative works based on the product or App.

    • Do not transmit defamatory, offensive, or objectionable material through the App.

    • Do not use the App in a way that could damage or impair our systems.

    • Do not collect or harvest information from our systems or attempt to decipher transmissions to/from our server.

15. Limitation of Liability:

    • Ensure the Product and App meet your requirements.

    • Use the App and Service for domestic use only; we are not liable for business-related losses.

    • Our maximum liability is limited to £30.

    • We do not exclude liability for death or personal injury from our negligence, fraud, or any other liability that cannot be excluded by law.

16. Severability and Governing Law:

    • Each paragraph of these Terms operates separately. If any are unlawful, the rest remain in effect.

    • These Terms are governed by English law, and disputes will be submitted to the non-exclusive jurisdiction of the English courts.
